The 2011/2012 edition of the Florida Claims Manual is our twenty-second edition and represents a continuing effort to provide current information to clients of our firm who are defending claims in the state of Florida. This Manual is designed to provide accurate information; but is not meant to be an exhaustive analysis; nor is it designed to provide the final word in any particular claim or issue. The Chapter on Employment Discrimination was authored by Doug LaPointe in our Orlando office.
The Chapter on Medications/Medical Terms was completed by Chris Coleman in our Ocala office and Chris is also a pharmacist.
The Florida Supreme Court has finally determined that the Graves Amendment is constitutional and if you are in the business of renting motor vehicles in the state of Florida please note that the Dangerous Instrumentality Doctrine has been severely limited. Please see Chapter II for a complete copy of the decision of Vargas v. Enterprise Leasing Company, etc., et al., 60 So.3d 1037 (Fla. 2011).
There are also significant changes in premises liability law and once again the burden of proof lies with the plaintiff to demonstrate actual or constructive notice for causes of action occurring after July 1, 2010. For a more detailed analysis of the changes to the premises liability law see Chapter VI.
